SOUTH AUSTRALIA–SPECIFIC LEGAL ADAPTATIONS
1. GOVERNING LAW & JURISDICTION (ADD THIS SECTION)
Governing Law
These Terms and Conditions are governed by the laws of South Australia. The parties submit to the exclusive jurisdiction of the courts of South Australia.
(This is critical and often missing. It prevents disputes being dragged interstate.)
2. RESIDENTIAL USE & SHORT-TERM ACCOMMODATION (SA-COMPLIANT)
Under South Australian planning and residential laws, Whites Beach Estate is approved for short-term residential accommodation only, unless otherwise agreed in writing.
Any use of the property for:
* events,
* functions,
* commercial activity,
* weddings,
* gatherings exceeding approved guest numbers
without written approvalconstitutes a material breach of this agreement and may result in:
* immediate termination of the booking,
* eviction without refund, and
* additional fees including unauthorised use penalties.
(This aligns with SA planning enforcement expectations and council complaints.)
3. LIABILITY & INDEMNITY (SA-APPROPRIATE WORDING)
To the extent permitted by South Australian law, Whites Beach Estate, its owners, employees and agents are not liable for injury, loss, damage or death suffered by guests or visitors, except where caused by proven negligence.
Guests agree to **indemnify and hold harmless** Whites Beach Estate against any claim, loss, damage or liability arising from:
* their stay,
* their visitors,
* their activities on or near the property,
* use of amenities including the beach, pool, fireplaces, fire pits and external areas.
(This respects Australian Consumer Law while still protecting you.)
4. AUSTRALIAN CONSUMER LAW (MANDATORY CLAUSE)
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) under the *Competition and Consumer Act 2010 (Cth) that cannot be excluded by law.
(This clause is legally required for enforceability.)
5. SECURITY BOND & FEES (SA-ENFORCEABLE STRUCTURE)
Security bonds are held in accordance with South Australian contract law and may be applied to cover:
* damage,
* theft,
* unauthorised guests,
* excess cleaning,
* breach of house rules,
* unauthorised gatherings or events.
Guests authorise Whites Beach Estate to charge the credit card provided or deduct from the cash bond where breaches occur.
Itemised evidence may be provided upon request.
(Avoids Residential Tenancies Act confusion — short stays are exempt.)
6. NOISE & NEIGHBOUR COMPLIANCE (SA-SPECIFIC)
Guests must comply with South Australian noise regulations, including but not limited to:
* Environmental Protection (Noise) Policy 2007 (SA)
* local council noise restrictions
Quiet hours apply from 10:00pm to 7:00am, unless otherwise approved in writing.
Any breach resulting in complaints, council attendance or police involvement may result in immediate eviction without refund.
7. FIRE SAFETY & TOTAL FIRE BAN DAYS (CRITICAL FOR SA)
Guests must comply with South Australian fire safety laws, including restrictions during:
* Total Fire Ban Days
* periods of extreme or catastrophic fire danger
On declared Total Fire Ban Days:
* all solid fuel fires, fire pits and open flames are strictly prohibited
* penalties may apply under SA law
Guests are responsible for checking fire danger ratings and complying with all restrictions.

8. POOL & WATER SAFETY (SA DUTY OF CARE)
The pool and surrounding areas comply with South Australian safety standards.
However, no lifeguard is on duty.
Guests acknowledge:
* swimming is at their own risk,
* children must be supervised at all times,
* alcohol consumption increases risk around water.
Whites Beach Estate accepts no responsibility for injury or death arising from failure to supervise or unsafe behaviour.
9. SECURITY CAMERAS & PRIVACY (SA-COMPLIANT)
Security cameras are installed externally only and operate in accordance with:
* *Surveillance Devices Act 2016 (SA)*
* Australian Privacy Principles (APPs)
No cameras are located inside the accommodation.
Footage may be reviewed in the event of:
* noise complaints,
* unauthorised gatherings,
* safety incidents,
* property damage.
10. EVENTS, WEDDINGS & FUNCTIONS (PRIVATE PROPERTY CLARITY)
Whites Beach Estate is private property.
No sale or supply of alcohol is provided or permitted by the venue unless otherwise stated in writing.
Any approved event may require:
* separate event agreement,
* public liability insurance,
* guest list approval,
* noise and curfew compliance.
Unauthorised events will incur a **minimum $10,000 fee** and immediate termination.
11. FORCE MAJEURE
Whites Beach Estate is not liable for cancellations, delays or interruptions caused by events beyond reasonable control, including but not limited to:
* extreme weather,
* bushfires,
* government restrictions,
* utility outages,
* natural disasters.
